Prevailing wage determination delays at the NPWC

Ask an immigration team how a case is progressing and you will be told it is 'in PERM'. Ask when the ETA-9089 was filed and, often enough, it has not been — the case is waiting on a wage determination that has no case number anyone is tracking.
Why this stage is invisible
The prevailing wage determination comes first. Recruitment cannot be designed around a wage that has not been issued, and the ETA-9089 cannot be filed until recruitment is complete and the quiet period has run.
So a case waiting on a PWD is not in the PERM queue at all. It is in a different queue, at a different office, with its own published processing figures — and most internal trackers have no field for it.
The consequence is that delay accumulates silently and is discovered late, usually when someone works backwards from an H-1B sixth-year date and finds the buffer has gone.
Reading the queue properly
The Office of Foreign Labor Certification publishes, for each stage, the month it is currently processing. That is a queue position, not an average wait, and the difference matters.
A determination filed in March, when the office is processing December, tells you how far back the front of the queue is — not how long your case will take. Track the movement month to month. A queue advancing one month per month is stable; a queue advancing two weeks per month is falling further behind and the buffer needs to grow.
Capture these figures with dated screenshots. If the case ever becomes a delay claim, contemporaneous queue data is the evidence that carries weight, and it cannot be reconstructed.
Managing the exposure
- Start earlier than the plan requires. The PWD is the cheapest buffer in the whole process because nothing else is committed yet.
- Get the job description right first time. A determination that comes back at an unworkable wage level sends the case back to the start of the queue, and that is the most expensive form of this delay.
- Understand the validity period on the determination once issued, and sequence recruitment to complete inside it.
- Track PWD filing dates in the same system as everything else. If it is not in the tracker it is not being managed.
Where a determination has sat far outside the published window for its own filing month, that is an abnormal case rather than a slow one, and the options for DOL delay become worth considering.

- Can a prevailing wage determination be challenged?
- A request for redetermination or review is available where the employer believes the determination is wrong. It adds time, so weigh it against the cost of the wage.
- Does using a private wage survey speed things up?
- It does not shorten the queue and it invites scrutiny. It is a wage-level decision, not a timing one.
